Please read these terms carefully before renting any drone equipment from JUANDER GEAR DRONE RENTAL (JGDR). By proceeding with a rental, you agree to be bound by these conditions.
1.1 The Renter must be at least eighteen (18) years of age.
1.2 The Renter shall provide valid government-issued identification prior to rental.
1.3 WGDR reserves the right, at its sole discretion, to refuse or cancel any rental transaction.
2.1 Upon release of the Equipment, full responsibility and risk are transferred to the Renter.
2.2 The Renter assumes all risks associated with the use of the Equipment, including but not limited to: accidental damage, crash incidents, loss or flyaway, water damage, signal interference, user or pilot error and environmental or weather-related causes.
2.3 Responsibility shall remain with the Renter until the Equipment is returned and inspected by WGDR.
3.1 The Equipment shall be used solely by the Renter and for lawful purposes only.
3.2 The Renter agrees to comply with all applicable laws, rules, and regulations of the Republic of the Philippines.
3.3 The Renter shall not: allow third parties to operate the Equipment, operate in restricted or prohibited areas, use the Equipment in unsafe conditions and use the Equipment for commercial purposes without prior written consent from WGDR.
4.1 A refundable security deposit shall be required prior to release of Equipment.5.2 The Renter hereby authorizes WGDR to deduct from the deposit any Damages, losses, missing items, unpaid rental or late fees
4.2 The deposit shall be refunded within **twenty-four (24) to seventy-two (72) hours** following inspection, subject to any applicable deductions.
5.1 The Renter shall be fully liable for any damage, loss, or theft of the Equipment during the Rental Period.
5.2 WGDR reserves the right to charge: the full cost of repair; or the full replacement value of the Equipment
5.3 The Renter agrees that full replacement value shall be immediately charged in cases including but not limited to: non-return of Equipment, total loss or flyaway, water submersion and irreparable damage
6.1 The Renter shall not: Modify, alter, or attempt to repair the Equipment;, Use the Equipment for unlawful or hazardous activities and Transfer possession or control of the Equipment to another party. Any violation shall result in immediate termination of the Agreement and full liability on the part of the Renter.
7.1 The standard rental period shall be twenty-four (24) hours from the time of release.
7.2 Late Return Charges: ₱____ per hour of delay, Total late fees shall not exceed one and one-half (1.5x) times the daily rental rate
7.3 If the Equipment is not returned within five (5) days without prior arrangement, WGDR shall charge the Renter the full replacement value of the Equipment.
8.1 Cancellations made at least forty-eight (48) hours prior to the Rental Period shall be eligible for a full refund.
8.2 Cancellations made within twenty-four (24) to forty-eight (48) hours shall be eligible for a fifty percent (50%) refund.
8.3 Cancellations made less than twenty-four (24) hours prior, or failure to appear, shall be non-refundable.
9.1 The Equipment shall be inspected prior to release.
9.2 By accepting the Equipment, the Renter acknowledges that it is in good working condition and free from defects.
10.1 WGDR shall not be liable for: loss of data or footage, personal belongings, injury, death, or property damage, any indirect, incidental, or consequential damages arising from the use or misuse of the Equipment.
11.1 The Renter agrees to indemnify and hold WGDR harmless from any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising from the Renter’s use or misuse of the Equipment.
12.1 This Agreement shall be governed by the laws of the Republic of the Philippines. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the appropriate courts of the Philippines.
13.1 This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral. If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.
14.1 The Renter agrees to provide proof of travel itinerary or return flight details. WGDR reserves the right to refuse rental if sufficient proof of return travel is not provided.
